Kalainaya ("Kalainaya," "we," "us," "our") — Chennai, India

These Terms of Service ("Terms") govern your use of kalainaya.shop (the "Site") and any quote request or order you place with us. By browsing the Site or submitting a quote request, you agree to these Terms.

1. What This Site Does

Kalainaya is a browsing and quote-request catalog for Navarathri Golu dolls, sourced from artisan workshops in Tamil Nadu (Panruti, Thanjavur, Villianur, Kanchipuram, and brass casters in Kumbakonam). There is no checkout and no payment taken on this Site. Adding items to the cart only builds a list for a quote request — it does not reserve stock or create any obligation on either side.

Kalainaya acts solely as a curator and facilitator. Kalainaya is not the seller, manufacturer, packer, shipper, or payment recipient for any piece shown on this Site. All pieces are made, priced, packed, shipped, and sold directly by independent artisan suppliers in India, and all payments are made by you directly to those suppliers. Any resulting sale is a transaction between you and the supplier, not between you and Kalainaya.

2. How Quoting & Ordering Works

  1. You add pieces to your cart and submit a quote request with your full delivery address and contact details.
  2. We collect pricing from the artisan supplier and relay an itemised quote, typically within 48 hours.
  3. The quote covers the dolls only. Shipping cost and any duties/taxes are determined after the supplier packs and weighs your order, and are confirmed separately before dispatch.
  4. All further steps — availability, changes, payment, packing, and delivery — are arranged personally with you by email or WhatsApp, outside this Site. Payment is made directly to the artisan supplier in India; Kalainaya never collects, holds, or processes your money.
  5. A quote request is not an order and is not binding. No order is confirmed, and no payment obligation exists, until you expressly agree on final pricing, shipping, and payment through email/WhatsApp.
  6. You may change or cancel a quote request at any time before an order is mutually confirmed, at no cost, by replying to our email or WhatsApp message.

3. Product Information & Natural Variation

  • Golu dolls are hand-made from terracotta, painted clay, papier-mâché, carved rosewood, or cast brass. Each piece is finished individually, so color, texture, and fine detail will vary from the photos shown and from piece to piece. This is a feature of handcraft, not a defect.
  • Where a listing shows "Image coming soon," the piece's appearance will be confirmed with your quote.
  • Stock, availability, and exact workshop sourcing can change; we will tell you if a piece you've listed is unavailable.
  • We offer custom sizing, repainting, name-plates, and themed sets on request — feasibility and timing are confirmed individually, not guaranteed by anything shown on the Site.

4. Pricing

  • No prices are listed on the Site. Prices are quoted per order based on the specific pieces requested.
  • Quoted doll prices are provided separately from shipping and duties, which are calculated after packing and weighing.
  • Quotes are valid for a limited time (to be confirmed at the time of quoting) and may change afterward due to material cost or availability.

5. Shipping, Customs & International Orders

  • Orders are packed and shipped worldwide from India by the artisan supplier, not by Kalainaya. See our separate Shipping Policy for delivery timing, methods, and packaging.
  • Customs duties, import taxes, and any handling fees charged by your country are your responsibility and are not included in the doll quote. We provide accurate invoices declaring goods as handicrafts.
  • Delays caused by customs authorities, carriers, or destination-country processing are outside our control, and we are not liable for them.

6. Payment

  • All payments are made directly to the artisan supplier in India using the method agreed with you over email or WhatsApp. Kalainaya never collects, holds, processes, or refunds any payment.
  • We do not process or store any payment card or bank details through this Site, and we are not a party to the payment transaction between you and the supplier.
  • Any payment dispute, refund, or chargeback is a matter between you and the supplier who received your payment.

7. Limitation of Liability

To the fullest extent permitted by law:

  • Kalainaya is a facilitator only. As Kalainaya is not the seller, shipper, or payment recipient, responsibility for product quality, accuracy, packing, shipping, delivery, refunds, and claims rests with the artisan supplier who sells and ships your order. Kalainaya will help you raise and pursue a claim with the supplier in good faith, but does not itself guarantee any outcome.
  • To the fullest extent permitted by law, Kalainaya accepts no liability for the acts, omissions, delays, quality, or performance of any artisan supplier or carrier.
  • We are not liable for indirect, incidental, or consequential losses, including disappointment over festival timing, delayed arrival, or inability to complete a padi display by a certain date.
  • We are not liable for delays or failures caused by events beyond our reasonable control, including customs holds, carrier disruption, natural events, strikes, or government action.
  • Products are decorative/ritual display items; no warranty of fitness for any purpose beyond that is given by Kalainaya.

8. Intellectual Property

Site content, photography, and the Kalainaya name and logo belong to Kalainaya and may not be copied or used commercially without written permission.

9. Governing Law

These Terms are governed by the laws of India. Any dispute will be subject to the courts having jurisdiction in Chennai, Tamil Nadu, India, without prejudice to any non-waivable consumer rights you hold under the law of your own country.

10. Changes

We may update these Terms at any time; the "Last updated" date above will reflect the latest revision. Continued use of the Site after changes means you accept the updated Terms.

11. Contact
